General Terms and Conditions Fankhauser Outdoorsport

  1. Registration can be made in writing, by phone, online, or in person. We will confirm your registration by phone, email, or in writing, and it is therefore binding.
  2. PAYMENT:
    Upon receipt of your travel confirmation/invoice, please transfer the amount shown. Short-term bookings must be paid immediately.
  3. Cancellation by the customer:
    You can cancel your trip at any time before departure. In your own interest and to avoid misunderstandings, we strongly recommend that you submit your cancellation in writing. As compensation for travel arrangements and expenses, we may request a percentage of the trip price, depending on how close the cancellation date is to the start of the trip, taking into account the following breakdown:
    (In any case, a minimum processing fee of €50)
    3 to 1 month before departure: 40%
    30 to 7 days before departure: 70%
    6 days or more before departure: 100%
  4. Participation in day tours and the use of certain services is not suitable for pregnant women and is therefore not permitted. In the event of pregnancy, the participant may cancel the booking for the day tour or other service, but not the overnight stay, free of charge up to 7 days before the service is due to begin.
  5. It is not permitted to bring strangers into the accommodation.
  6. Garbage containers are available on the east side of the building. All guests are required to comply with the municipal waste separation regulations.
  7. The designated pitches on the camping meadow must be adhered to. The barriers along the meadow after entry must be reinstalled.
  8. In general, after using the areas, tents, kitchens – everything must be left properly.
  9. When using the BBQ area, it is not permitted to remove the grill grate. Campfires in the fire bowl are permitted – however, please observe the height of the fire. Ashes may only be placed in designated containers.
  10. The kitchen in the hostel is exclusively for the residents of the hostel floor and not for camping or apartment guests.
  11. Access to the station roof on the north side via the balcony on the 1st floor, kitchen and room 7 is expressly prohibited.
  12. The participant is liable for any damage to the accommodation, including the BBQ area and the rest of the premises, as well as any deliberate destruction or soiling of materials in the house/premises/activities (e.g., peeing in the wetsuit or defecating). Replacement costs, cleaning costs, and costs resulting from non-use/non-rental are the responsibility of the participant/perpetrator.
  13. Moving around the Fankhauser OutdoorSport premises is at your own risk and Fankhauser OutdoorSport assumes no liability.
  14. Guests must strictly adhere to the quiet hours of 10 p.m. to 7 a.m. while in our house and on our premises. Failure to comply will result in removal from the premises and a trespass lawsuit.
  15. Parking on our premises is free of charge. Fankhauser OutdoorSport assumes no liability for any damage.
  16. Each guest undertakes to meet the mental and physical requirements necessary for the selected tour, as stated in the detailed description and in the terms and conditions of Fankhauser OutdoorSport.
  17. All participants in Fankhauser OutdoorSport tours are aware that they are taking part in an adventure activity that cannot offer the comfort and safety of a standard package tour. The risks are diverse, and the possibility of injury or even death cannot be ruled out. Fankhauser OutdoorSport tours are led by certified guides. Equipment complies with the latest safety standards. All tours are meticulously planned and prepared. Before each tour, a comprehensive briefing is provided by the guide. Liability for all damages and claims, regardless of the legal basis, against Fankhauser OutdoorSport and the guides is limited to gross negligence and willful misconduct. Fankhauser OutdoorSport is not liable for damages resulting from activities that go beyond the booked program. In the case of consumer transactions within the meaning of the Consumer Protection Act, this only applies to the extent that these damages do not involve personal injury.
  18. Persons impaired by medication, alcohol or drugs are excluded from the tour and are not entitled to compensation.
  19. For the benefit of all participants, the guest must follow all safety instructions given by the tour guide and actively participate in the tour. Tour participants should support one another.
  20. The participant is obliged to assist in transporting the boat to and from the transport vehicle.
  21. Substitutes:
    Up until the start of the trip, you may appoint a third party to represent you during the trip. Any additional costs incurred will be borne by you. We may refuse to accept a substitute if the third party does not meet the specific travel requirements or if legal regulations prevent this.
  22. All prices are per person unless otherwise stated.
  23. Unused Services:
    If the traveler does not use individual travel services for whatever reason, no refund of the travel price or deposit will be made. In cases of hardship (illness, accident, etc.), we may issue vouchers for individual and canceled travel services at our discretion, provided that we are notified of the non-use in a timely manner. We recommend purchasing travel cancellation insurance! If the event participant does not attend the event at the agreed time or does not attend on time, there is no entitlement to a refund of the travel price.
  24. Rebookings:
    Where possible, we will endeavor to rebook travel services even after the contract has been concluded. Any additional costs incurred as a result will be reimbursed.
  25. Liability, Limitations of Liability:
    We provide the contractually agreed travel services with the due care of a prudent businessman. Participation in all activities is at your own risk. The tour operator assumes no liability or liability for willful misconduct, and limits our liability, regardless of the legal basis, to three times the tour price. We are not liable for service disruptions in connection with services that we merely arrange as third-party services. In this case, the travel conditions of the respective tour operator apply.
  26. Duty to cooperate:
    You are obligated to cooperate within the framework of the statutory provisions in the event of service disruptions, to avoid or minimize any damage. In particular, you are obligated to report your complaints immediately on site or to our staff. We or our staff will endeavor to address these complaints, if possible. If you negligently fail to report a defect, you will not be entitled to a reduction in the travel price or compensation.
  27. Keeping Animals:
    Animals may only be brought into the accommodation facility after consultation with us and for a special fee. Guests bringing animals are obligated to properly care for and supervise the animal during their stay. Furthermore, they or their insurer are liable for any damage caused by animals. Animals are only permitted on the camping grounds.
  28. The guide reserves the right to exclude or cancel any guests who violate our terms and conditions, particularly those who fail to meet the necessary requirements for the tour. The guide reserves the right to modify, expand, or restrict the tour program due to unforeseen circumstances that could endanger the safety of guests (e.g., high water levels, sudden weather changes, or insufficient skills of the participants). Fankhauser OutdoorSport reserves the right to withdraw from the contract due to such circumstances.
  29. Injuries and damage must be reported to the guide immediately.
  30. The duration of a tour cannot always be precisely determined. The times listed are only guidelines. Fankhauser OutdoorSport assumes no liability for adherence to these guidelines.
  31. Some of the travel to and from the tour areas is done by private vehicle. This transportation is not part of our program. We therefore assume no liability for accidents or damage that may occur.
  32. Price and program changes and corrections of printing errors are reserved.
  33. Transport for rafting, canyoning, canoeing or SUP tours requires sufficient swimming skills in flowing water.
  34. Children under 6 years of age are not permitted to travel. Children between 6 and 14 years of age will only be transported if accompanied by a suitable adult who is at least 19 years old.
  35. During the tour, participants must ensure that the helmet chin strap and life jacket buckles are fastened. Each participant must ensure that they have all the necessary equipment for the tour. The guide reserves the right to exclude a participant from the tour if the equipment is incomplete and this is due to negligence on the part of the participant.
  36. The participant is liable for any deliberate damage to boats and equipment.
  37. It is the participant's responsibility to exercise extreme caution when entering and exiting the boat, as shallows, slippery rocks, varying currents, and boat movement are to be expected, which increase the risk of injury. The participant acknowledges that risks and hazards cannot be completely eliminated in whitewater sports.
    (1) Loss of control of the boat, flipping, falling into or out of the boat; possible collision with other participants, equipment, other boats, rocks, trees, and other obstacles.
    (2) Decision-making and execution by the guide.
    (3) Submersion in water, drowning.
    (4) Exposure to nature, inclement weather, remote areas, including travel on foot/by vehicle, related to the event.
    (5) Assistance with transporting equipment.
    (6) Rescue, injuries, and
    (7) In the event of an injury, the lack of adequate medical treatment on site.
  38. Additional conditions for power rafting/canoeing/SUP tours: Each participant must ensure that the entire group maintains eye contact at all times. If necessary, stop at appropriate points to reestablish eye contact. Please note that no Fankhauser OutdoorSport guide will be present in the boat on these tours. After a safety briefing and technical training, the guide will accompany the group in their own boat. Participants are responsible for steering their boat and avoiding any potential hazards. Fankhauser OutdoorSport assumes no liability for damages or claims arising from such tours.
  39. Canyoning takes place largely in pathless terrain, where particularly slippery passages must be expected. Therefore, slipping must be expected at any time. Each participant must therefore proceed with extreme caution and caution. The tour leader will demonstrate how to proceed. All areas where there is a risk of falling may only be accessed with safety equipment and under the supervision of the canyoning guide. Rockfall is a danger in canyons.
  40. Each participant must ensure that eye contact with the participants and the canyoning guide is not lost.
  41. Canyoning tours use special equipment. Each participant receives detailed training on how to use this equipment before and during the tour. This equipment must be handled with extreme care.
  42. Jumping is only permitted with the guide's express permission, and instructions must be followed exactly. The water depths in the pools vary, so jumping is only permitted in the area designated by the canyoning guide. If the guest believes this is not possible, the canyoning guide is obligated to find alternative ways to safely overcome the difference in altitude. Each participant is responsible for choosing a safe, non-slip jumping point. It is always to be expected that the legs will touch the bottom, which is why the jump must be cushioned with the legs. Sliding in the riverbed must be done in a leaning position, with the head tilted forward and hands clasped.
  43. Each guest must ensure that their harness, helmet, and carabiner are always securely fastened. Any irregularities must be reported immediately to the canyoning guide. Each participant must provide reasonable assistance upon request from the canyoning guide.
  44. Participants are not allowed to leave the group on their own.
  45. Activities using rental equipment from Fankhauser OutdoorSport are conducted without a tour guide. Activities are undertaken at your own risk. Fankhauser OutdoorSport assumes no liability for damages.
  46. The renter is liable for any damage that occurs to the rented equipment.
  47. Photos/Films: Participants agree that photos and films taken during an event may also be published in brochures, social media channels or on the Fankhauser Outdoorsport homepage.
  48. All agreements with Fankhauser OutdoorSport are subject to Austrian law. The place of performance is the registered office of Fankhauser OutdoorSport, and the place of jurisdiction is Kitzbühel.
  49. By successfully booking an event/overnight stay with Fankhauser OutdoorSport, participants agree to the general terms and conditions of Fankhauser OutdoorSport.
